General Terms and Conditions

1. Scope
These General Terms and Conditions apply to all transport services provided by Mobimed Patiententransport GmbH (hereinafter «Mobimed») to clients — hospitals, clinics, care homes and nursing homes, Spitex (home care) organisations, medical practices and private individuals. Any deviating agreements must be made in writing.
2. Scope of services
Mobimed transports patients in a stable physical condition — by stretcher, in a wheelchair or seated. The service includes accompanying the patient from the pick-up location to the destination, including assistance with getting in and out of the vehicle.
Mobimed is not an emergency medical service. Emergency care, the administration of medication and the maintenance of vital functions are not part of the service and must be provided by an emergency medical service. In an emergency, dial the emergency number 144.
For stretcher transport, a second trained transport assistant accompanies the journey. No medical escort is provided for wheelchair and seated transport. One accompanying person from the patient’s personal circle travels free of charge.
3. Placing orders
Orders can be placed by phone, by e-mail or via the online form. An order is only deemed accepted once Mobimed has confirmed it. The automatic acknowledgement of receipt sent by the online form does not constitute acceptance.
The client is obliged to provide all information essential for the safe performance of the transport completely and correctly — in particular the type of transport, the patient’s weight, oxygen requirements, any isolation situation, the accessibility of the pick-up location and any other relevant circumstances. Incorrect or incomplete information may mean that the transport cannot be carried out; any costs incurred as a result shall be borne by the client.
Planned transports should, where possible, be booked at least one day in advance.
4. Cancellation and rescheduling
Cancellations and changes of schedule must be notified by phone as early as possible. If a transport is not cancelled in good time and the vehicle has already set off, Mobimed may invoice the costs incurred.
5. Times
Pick-up and arrival times are planned to the best of our knowledge. Traffic, weather, delays on previous transports and waiting times at institutions may lead to deviations. Mobimed is not liable for the consequences of late arrival unless the delay was caused through gross negligence or wilful intent.
6. Prices and payment
Prices depend on the type of transport, distance, time and the level of assistance required. On request, Mobimed will quote the price before the order is placed. Invoices are payable within 30 days of the invoice date.
Any contribution by the health insurer is a matter for the client or the patient. Mobimed issues the documents required for submission but gives no guarantee that the costs will be covered by third parties.
7. Liability
Mobimed is liable for damage caused wilfully or through gross negligence by its employees. Liability for slight negligence and for indirect and consequential damage is excluded to the extent permitted by law.
No liability is accepted for personal belongings, luggage, aids and files carried, unless Mobimed is at fault. Valuables should not be left unattended in the vehicle.
8. Data protection
The processing of personal data, including health data, is governed by our privacy policy. By placing an order, the client consents to the processing of the data required to carry out the transport and undertakes to obtain the patient’s consent for this where necessary.
9. Applicable law and place of jurisdiction
Swiss law applies. The place of jurisdiction is Binningen, unless mandatory statutory provisions stipulate a different place of jurisdiction.
